Terms of Service
General Terms and Conditions of Finqu. By using the finqu.com service, you accept these terms.
1. Applicability and Validity of the Terms
These terms apply to the products and services provided by Finqu Ltd (hereinafter referred to as the "Service Provider") to its customers through finqu.com. These terms come into force on February 1, 2024, and are valid until further notice.
2. Formation and Transfer of Agreement
The agreement is established when the customer registers for the Finqu service via the website or through resellers, or orders the service via AI execution. The Service Provider reserves the right to transfer the agreement and/or services to a third party and to amend the content of the agreement and/or service description. The Service Provider also reserves the right to disclose any information required by Finnish law to the authorities.
The customer has the right to transfer the agreement to a third party by changing the contact information on their Finqu account. The Service Provider reserves the right to reject the transfer of the agreement.
3. Contract Duration and Termination
The contract period for the service is always one month or until the end of the selected longer billing period. The contract for a terminated service ends at the conclusion of the current billing period, after which the account is closed, and all data on the account is automatically deleted. The notice period for termination is the current billing period (1 month, unless a longer billing period is in use).
Vouchers and other benefits cannot be converted into cash.
The Service Provider reserves the right to terminate the service immediately without a notice period if the customer has violated the terms of the agreement, or if the continuation of the service is not possible (e.g., in the case of a force majeure situation).
4. Delivery of the Ordered Service
The Service Provider reserves the right not to deliver the ordered service without separate notice, reason, or notification.
5. Service Content, Production, Customer Rights, and Responsibilities
The Service Provider may provide the contracted service in any manner it sees fit. The Service Provider reserves the right to amend the content of the agreement and the service, endeavoring to notify customers in advance whenever possible. Changes requested by the customer may incur a fee in accordance with the Service Provider’s general price list.
The Service Provider applies for an SSL certificate through third-party registration services. The Service Provider acts solely as an intermediary in the registration process and registers the services using the customer’s provided information. The Service Provider is not responsible for the registries or services of third parties.
The Service Provider provides the online store with a free Finqu domain chosen by the customer (storename.finqushop.com). The Service Provider reserves the right to reject or remove the selected address, after which the customer will be offered the opportunity to select a new free address. The free Finqu domain is the property of the Service Provider and cannot be transferred to another service provider.
The customer is responsible for the content uploaded to the service and must ensure that the added code does not expose the service or server to attacks, breaches, or similar activities, and that the content is not offensive, unlawful, or contrary to law or good practices, or exceeds the allocated resources for the service. The Service Provider reserves the right to remove content or code if it considers that the content violates these terms.
The customer must ensure that their activities on the internet comply with law and good practices. Unauthorized use or attempted use of the Service Provider’s or third parties’ servers and services is prohibited. The customer is strictly prohibited from searching for or exploiting any potential security vulnerabilities, which may lead to immediate termination of the agreement and possible claims for damages.
If the customer’s use of server resources exceeds that of a typical Finqu customer, the Service Provider reserves the right to adjust the service charges accordingly. The Service Provider reserves the right to prioritize traffic in such cases.
The customer is allocated features equivalent to the product count of the selected plans, and 50 gigabytes of storage space for product images and attachments. Larger resource requirements must be negotiated, with pricing adjusted accordingly.
The customer is responsible for all financial transactions conducted through the online store. When using third-party payment applications (e.g., Klarna, Stripe), the customer must monitor the payment approvals in the respective payment service providers’ platforms. The Service Provider is not responsible for any errors or incomplete payment statuses or information that may appear in the order management of the service. The customer must always verify payment before delivering products.
The Service Provider’s liability for the provision of services is limited to the amount the customer has paid for Finqu services in the preceding 60 days. The Service Provider is not liable for indirect damages that may be caused to the customer due to technical or other reasons.
The Service Provider reserves the right to prevent activities that are in breach of the agreement using technical means.
Under no circumstances may the customer disclose their user credentials to third parties. The customer is responsible for all actions taken using their credentials.
The customer is responsible for all services and goods sold through the online store, their delivery, and all other matters related to online commerce and sales. The Service Provider is not responsible in any situation for the customer’s business transactions or related activities.
The Service Provider reserves the right to temporarily suspend service production if necessary for repairs, maintenance, or other work. The Service Provider will seek to minimize the duration of the interruption and notify the customer in advance whenever possible.
The Service Provider is not responsible for errors or service interruptions caused by force majeure, human error, or third-party actions.
6. Usernames and Passwords
The Service Provider reserves the right to change usernames and passwords if necessary, notifying the customer accordingly.
7. Payment for the Service and Pricing
The customer pays for the ordered services in accordance with the selected billing period. Billing is done in advance.
The current price list can be found on the service’s homepage. The Service Provider reserves the right to change service prices, and their contents. Changes to service plans and prices will be announced on the homepage at least 30 days before they take effect.
8. Service Suspension and Termination
The Service Provider has the right to suspend access to the customer’s Finqu account and initiate service termination if the customer has an overdue and unpaid invoice.
The Service Provider has the right to terminate the customer’s service without notice if the customer’s invoice is overdue, no payment agreement has been made, the customer violates the terms of the agreement, or the customer has been declared bankrupt or convicted of fraud.
